Right of Withdrawal

The user may revoke the purchase or withdraw from the contract within 14 calendar days without the need for justification. The withdrawal period will expire 14 calendar days from when you or a third party indicated by you, other than the carrier, acquired material possession of the goods.

To exercise the right of withdrawal, you must notify us of your decision to withdraw from the contract through an unequivocal statement. If the cause of the return was that the returned item is defective or does not correspond to what was requested in the order, NEWGARDEN SPAIN, SL will bear the costs of the return and new shipment.

If the reason for the return is that the order does not satisfy you:

  • We will refund the amount, including delivery costs (except delivery costs if you have chosen an option other than ordinary delivery, in this case only the costs assigned by the website for ordinary delivery will be refunded) without undue delay.
  • The return will be made no later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract.
  • You must assume the direct cost of returning each of the goods.

  • The refund will be made using the same means of payment that was used in the initial transaction, unless you have expressly provided otherwise, and as long as it does not entail additional expenses.
  • The company reserves the right to withhold reimbursement until the goods have been received, or until you have provided proof of return of the goods, depending on which condition is met first.

Exceptions to the right of withdrawal

The right of withdrawal will not be applicable to contracts that refer to the supply of goods made according to the specifications of the consumer and user, clearly personalized or commissioned. Those that are made to order at the customer's request will be expressly indicated in the product description.

Neither will the right of withdrawal be accepted when the item to be returned is not exactly the one purchased, has been unsealed after delivery, is not in perfect condition or has been opened or used.

    Through the website www.newgardenshop.es, you can consult the current rates without VAT, unless otherwise indicated. Taxes can be consulted in the shopping cart.

    Payment Methods

    Payment will be made through any of the following means:

    - Transfer; If you choose payment by bank transfer at the end of the purchase process, the account number to which the transfer must be made will be specified, as well as a reference number that will have to be specified at the time of making the transfer. Once your payment is confirmed, we will proceed to send your order.

    Warranty

    All our products have at least three years of legal guarantee, for which NEWGARDEN SPAIN, SL is responsible as the seller of the product, in the legally established terms.

    In the same way, manufacturers offer a commercial guarantee that, on occasions, can improve the terms and conditions of the legal guarantee. That is why it is very important that you read the guarantee conditions of each product, and save the proof of purchase, since they will be necessary for you to benefit from the guarantee.

    Deficiencies caused by negligence, blows, improper use or manipulation, unsuitable voltage, incorrect installation not carried out by the authorized Technical Service when appropriate, or materials subjected to wear due to normal use are not included.

    In those incidents that justify the use of the guarantee, the repair, replacement of the article, discount or return will be chosen, in the legally established terms.

    Governing Law and Forum

    This purchase system is subject to the legislation in force in Spain (Civil Code, Commercial Code, Law 7/1996, of January 15, on the regulation of retail trade, Law 7/1998, on the General Contract Conditions, Law 26/1984, General for the Defense of Consumers and Users, Royal Decree 1906/1999, of December 17, regarding telephone and electronic contracting with general conditions and Law 34/2002, on Services of the Information Society and Electronic Commerce).

    Pursuant to Law 34/2002 of July 11, the contract will be presumed to be held at the seller's domicile (Spain). If in your case there are disagreements that may arise as a result of this contractual relationship and cannot be resolved amicably, they will be submitted to the Courts that are considered competent in each case.
