These General Terms and Conditions regulate the use of the website www.newgarden.es, property of NEWGARDEN SPAIN, SL, with registered office at Avda. Francia, 5 – 15. Pol. Ind. Las Salinas de Alhama, 30840, Alhama de Murcia (MURCIA), e-mail info@newgarden.es and telephone number 968978886 with CIF B98434665, and registered in the Mercantile Registry of Murcia, volume 1879, folio 1, registration sheet MU-40290.

Any order placed on www.newgarden.es necessarily implies, as an essential, determining and indispensable condition, the unreserved acceptance by the Client of the General Conditions of Use in force on the day on which the corresponding order is placed. Furthermore, the Client acknowledges that the acceptance of these conditions will imply the application of these to the order to which they refer, as well as to any subsequent order, except in those cases in which new conditions are brought to the Client's attention.

Users

In order to purchase any of the products shown on www.newgarden.es, the user must be legally capable of doing so in accordance with the Spanish legal system.

There are two types of users: end consumers and professionals. If you are a professional, this will be specified at the time of registration by accessing the link for distributors.

These conditions of use are directed to the final consumer who purchases products at www.newgarden.es.

Purchase Procedure

Choose: choose the desired product, click on it, and you will see a detailed description of it. Once you have chosen, you can choose between the different options we provide. You can add the product to your shopping cart from the product itself.

Purchase: Once in the shopping cart, you will have to follow the steps established to confirm the purchase and provide the required data.

Confirmation: once you have identified yourself, all that remains is to confirm the order.

Upon completion of your order, you will be sent an email confirming receipt of your order and specifying all the details of the order. If you notice an error in the address provided or in any other part of the order, you must notify us immediately. info@newgarden.es to proceed with the correction of the error.

Prices

The prices published on www.newgarden.es are in Euros and are valid except for typographical errors.

The current rates without VAT can be consulted on the website www.newgarden.es, unless otherwise indicated. Taxes can be consulted in the shopping cart.

Payment Methods

Payment will be made through any of the following means:

Bank Transfer; If you choose to pay by bank transfer, at the end of the purchase process the account number to which the transfer must be made will be specified, as well as a reference number that must be specified at the time of making the transfer. Once your payment has been confirmed, we will proceed to ship your order.

Purchases made with a credit or debit card; the user must provide the name of the cardholder, the number, the expiration date and the CVV. All information will be processed through the bank's POS terminal.

Shipping

The purchased products will be delivered to the person and address indicated in the order within the maximum ESTIMATED DELIVERY TIME.

Shipping costs will be specified at the time of purchase.

WITHDRAWAL OF USED ELECTRONIC PRODUCT WITH THE SAME CHARACTERISTICS PURCHASED
Newgarden offers the customer the option of picking up a used electronic product with the same characteristics as the one sold upon delivery of their purchase.

Right of Withdrawal

The user may revoke the purchase or withdraw from the contract within 14 calendar days without giving any reason. The withdrawal period will expire 14 calendar days after you or a third party indicated by you, other than the carrier, acquired physical possession of the goods.

To exercise the right of withdrawal, you must notify us of your decision to withdraw from the contract by means of an unequivocal statement (for example, a letter sent by post, fax or email). You also have the option of completing and sending the model withdrawal form or any other unequivocal statement via info@newgarden.es. If you choose this option, we will promptly notify you, on a durable medium, of receipt of said withdrawal.

If the reason for the return is that the returned item is defective or does not correspond to what was requested in the order, NEWGARDEN SPAIN, SL will bear the costs of the return and new shipment.

If the reason for the return is that the order does not satisfy you:

  • We will refund the amount, including delivery costs (except delivery costs if you have chosen an option other than ordinary delivery, in this case only the costs assigned by the website for ordinary delivery will be refunded) without any undue delay.
  • The refund will be made no later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract.
  • You will be responsible for the direct cost of returning the goods, valued at 15 euros.
  • The refund will be made using the same payment method used in the initial transaction, unless you have expressly agreed otherwise, and provided that it does not entail additional costs.
  • The company reserves the right to withhold reimbursement until it has received the goods back, or until you have supplied evidence of having sent back the goods, whichever is the earliest.
  • If the customer is not satisfied with the product due to reasons other than defects or delivery errors, the customer will be responsible for shipping and its cost.

EXCLUSION: The right of withdrawal will NOT apply to personalized Products (color or lighting finish), made-to-measure, reconditioned products, Products made to the Customer's specifications or which have been the subject of a special order.

Warranty

All our products have at least a two-year legal guarantee, for which NEWGARDEN SPAIN, SL is responsible as the seller of the product, under the legally established terms.

Likewise, manufacturers offer a commercial guarantee that can sometimes improve the terms and conditions of the legal guarantee. That is why it is very important that you read the guarantee conditions of each product, and keep the proof of purchase, as you will need it to benefit from the guarantee.

This does not include defects caused by negligence, knocks, improper use or handling, unsuitable voltage, incorrect installation not carried out by the authorised Technical Service where applicable, or materials subject to wear and tear due to normal use.

In those incidents that justify the use of the guarantee, the option will be to repair, replace the item, discount or return it, in accordance with the legally established terms.

Applicable Law and Forum

This purchasing system is subject to the legislation in force in Spain (Civil Code, Commercial Code, Law 7/1996, of January 15, on the regulation of retail trade, Law 7/1998, on the general conditions of contracting, Law 26/1984, General for the Defense of Consumers and Users, Royal Decree 1906/1999, of December 17, regarding telephone and electronic contracting with general conditions and Law 34/2002, on Information Society Services and Electronic Commerce).

Pursuant to Law 34/2002 of 11 July, the contract shall be deemed to have been concluded at the seller's domicile (Spain). If there are any disagreements that may arise as a result of this contractual relationship and cannot be resolved amicably, the courts deemed competent in each case shall be responsible.
